Agreement to Terms

By accessing our website and engaging our services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any part of these terms, you may not use our services.

Services Provided

Innate Web Co. provides web design, web development, website hosting, maintenance, and related digital services. Specific services, deliverables, timelines, and pricing will be outlined in individual project proposals or contracts.

Project Process

Our typical project process includes:

• Consultation: Free initial consultation to discuss project scope and requirements
• Proposal: Written proposal with pricing, timeline, and deliverables
• Agreement: Signed agreement and deposit payment to begin work
• Development: Regular updates and milestone reviews during development
• Review: Client review period with included revisions
• Launch: Final approval and website launch

Payment Terms

Unless otherwise specified in your project agreement:

• A non-refundable $100 deposit is required before work begins
• Payment schedules will be outlined in your project proposal
• We accept Cash App, Venmo, Zelle, PayPal, and Credit Card
• Payment plans may be available upon request
• Late payments may result in project delays or suspension of services
• All payments are in USD

Refund Policy

Our refund policy is as follows:

• The initial deposit is non-refundable
• Once work has begun, payments are typically non-refundable
• If legitimate issues arise during the project, we will review them case-by-case
• We are committed to client satisfaction and will work to resolve concerns
• Communication is key—please raise concerns immediately rather than at project end

Client Responsibilities

As a client, you agree to:

• Provide timely access to necessary materials, content, and information
• Respond to requests for feedback within reasonable timeframes
• Ensure all content provided is accurate and legally appropriate
• Own or have rights to all content (text, images, logos) you provide
• Purchase and maintain your own domain name registration (we can assist)
• Make timely payments according to agreed terms

Revisions

Project proposals will specify the number of included revision rounds. Additional revisions beyond the agreed scope may incur extra charges. Revisions include minor adjustments, not complete redesigns or major feature additions.

For hosting clients, unlimited minor revisions are included as part of the monthly hosting fee.

Project Timeline

Timelines are estimates based on project complexity and client responsiveness. Delays in receiving client materials or feedback may extend the timeline. We will communicate any potential delays promptly.

Intellectual Property

Client Content: You retain all rights to content you provide (text, images, logos, etc.).

Final Deliverables: Upon full payment, you own the completed website and its custom design elements.

Code and Templates: We retain rights to underlying code, frameworks, and development tools. We may reuse general techniques and code libraries across projects.

Portfolio Use: We reserve the right to display your completed project in our portfolio unless otherwise agreed in writing.

Hosting Services

If you choose our hosting services:

• Hosting fees are billed monthly and must be paid on time
• We provide 99.9% uptime guarantee (excluding scheduled maintenance)
• Regular backups are performed, but you are responsible for maintaining your own backups
• Included services: security monitoring, software updates, unlimited minor revisions, SEO optimization
• We reserve the right to suspend services for non-payment or violation of terms

Third-Party Services

Some projects may require third-party services (payment processors, email services, etc.). You are responsible for:

• Setting up and paying for your own third-party accounts
• Complying with third-party terms of service
• Any fees charged by third-party services

We will integrate these services but do not control their availability or functionality.

Warranties and Disclaimers

We warrant that services will be performed professionally and in accordance with industry standards. However:

• We do not guarantee specific results (traffic, sales, rankings)
• Websites are provided "as is" after final approval
• We are not responsible for issues caused by client modifications, third-party services, or hosting providers (if not hosting with us)
• Browser compatibility is tested for major modern browsers

Limitation of Liability

To the maximum extent permitted by law, Innate Web Co. shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from our services shall not exceed the amount paid by you for those services.

Termination

Either party may terminate services with written notice. Upon termination:

• You are responsible for payment for all work completed to date
• We will provide work completed up to the termination point
• Deposits and payments for completed work are non-refundable
• We reserve the right to terminate services for non-payment or breach of terms

Confidentiality

We will keep confidential any proprietary information you share during the project. However, general business practices, publicly available information, and non-sensitive project details may be discussed or displayed in our portfolio.

Changes to Terms

We reserve the right to update these Terms of Service at any time. Changes will be posted on this page with an updated effective date. Continued use of our services after changes constitutes acceptance of the new terms.

Governing Law

These terms shall be governed by and construed in accordance with the laws of the United States, without regard to its conflict of law provisions.
